Rights & Remedies under the ARRA of 2009


On February 17, 2009, Congress passed and President Obama signed the American Recovery and Reinvestment Act of 2009 (ARRA), also referred to as the Recovery Act. The Recovery Act commits $787 billion in stimulus funds, of which a significant portion is dedicated to expanding support for medical, science and engineering research.

The Recovery Act includes protection for whistleblowers, as well as a description of the rights and remedies of those subjected to retaliation or reprisals for reporting what they reasonably believed was evidence of:

  1. gross mismanagement of an agency contract or grant relating to Recovery Act funds;
  2. a gross waste of Recovery Act funds;
  3. a substantial and specific danger to public health or safety related to the implementation or use of Recovery Act funds;
  4. an abuse of authority related to the implementation or use of Recovery Act funds; or
  5. a violation of law, rule, or regulation related to an agency contract (including the competition for or negotiation of a contract) or grant, awarded or issued relating to Recovery Act funds.
